Please read these Terms of Use carefully before using Moodlith. 

By using the app, you agree to be bound by these terms.

IMPORTANT MEDICAL DISCLAIMER

Moodlith is NOT a medical device and does NOT provide medical diagnosis, treatment, or professional mental health services.

The App is designed for personal wellness tracking and informational purposes only. It should never be used as a substitute for professional medical advice, diagnosis, or treatment.

1. ACCEPTANCE OF TERMS

By downloading, installing, accessing, or using Moodlith (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not use the App.

These Terms constitute a legally binding agreement between you and the App developer. You must be at least 13 years of age to use this App.

2. MEDICAL AND HEALTH DISCLAIMER

THIS APP IS NOT INTENDED FOR MEDICAL DIAGNOSIS, TREATMENT, OR PRESCRIPTION OF ANY MEDICAL CONDITION. THE APP IS PROVIDED FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY.

Not a Medical Device

Moodlith is a personal wellness and mood tracking tool. It does not diagnose, treat, cure, or prevent any medical condition, mental health disorder, or disease.

Not a Substitute for Professional Care

The App is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of qualified health providers with any questions you may have regarding a medical condition or mental health concern.

No Medical Emergency Services

If you are experiencing a medical emergency or mental health crisis, do not use this App. Contact emergency services immediately or call your local emergency number.

AI Insights Are Not Medical Advice

Any insights, recommendations, or patterns identified by the App's artificial intelligence features are for informational purposes only and do not constitute medical or clinical advice.

3. USER RESPONSIBILITIES

You are responsible for:

• The accuracy and completeness of all data you enter into the App or import from external sources

• Maintaining the security and confidentiality of your device and app data

• Using the App in compliance with all applicable laws and regulations

• Not using the App for any illegal or unauthorized purpose

• Ensuring any data you import is accurate and that you have the right to import such data

• Seeking appropriate professional medical or mental health care when needed

4. USE RESTRICTIONS

You agree NOT to:

• Use the App to diagnose, treat, or manage any medical or mental health condition

• Rely on the App for emergency medical or mental health situations

• Use the App to make life-threatening or critical health decisions

• Reverse engineer, decompile, or disassemble the App

• Modify, adapt, or create derivative works based on the App

• Remove or alter any proprietary notices or labels on the App

• Use the App in any way that could damage, disable, or impair the App

5. INTELLECTUAL PROPERTY

The App, including its design, code, graphics, user interface, and all content, is protected by copyright, trademark, and other intellectual property laws.

All rights, title, and interest in and to the App remain the property of the developer. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

6. DATA OWNERSHIP AND PRIVACY

You retain all ownership rights to your personal data and content entered into the App. Your data is stored locally on your device and is not transmitted to external servers.

By using the App, you acknowledge that you are solely responsible for backing up your data. The developer is not responsible for any loss of data resulting from device failure, deletion, or uninstallation of the App.

7. THIRD-PARTY SERVICES AND INTEGRATIONS

The App may integrate with third-party services, including:

• Apple HealthKit (for health metrics)

• Apple WeatherKit (for weather data)

• Apple Intelligence (for AI features)

• iOS Notifications (for reminders)

• WidgetKit & App Groups (for widget functionality)

Your use of these third-party services is subject to their respective terms of service and privacy policies. The developer is not responsible for the availability, functionality, or content of any third-party services.

8. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY

• WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE

• WARRANTIES OF NON-INFRINGEMENT

• WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF DATA

• WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE

The developer does not warrant that the App will meet your requirements or that the operation of the App will be uninterrupted or error-free.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY DAMAGES, LOSSES, OR CLAIMS OF ANY KIND, INCLUDING BUT NOT LIMITED TO:

• DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

• LOSS OF DATA OR INFORMATION (INCLUDING MOOD ENTRIES, NOTES, OR ANY USER DATA)

• LOSS OF PROFITS OR BUSINESS OPPORTUNITIES

• PERSONAL INJURY OR DEATH

• MEDICAL OR MENTAL HEALTH CONSEQUENCES

• DECISIONS MADE BASED ON APP DATA, INSIGHTS, OR RECOMMENDATIONS

• RELIANCE ON THE APP FOR ANY PURPOSE, INCLUDING WELLNESS OR HEALTH DECISIONS

• ERRORS, OMISSIONS, OR INACCURACIES IN THE APP OR ITS DATA

• INTERRUPTION OF SERVICE OR APP AVAILABILITY

• DEVICE DAMAGE OR MALFUNCTION

THE DEVELOPER SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, INCLUDING BUT NOT LIMITED TO NEGLIGENCE, BREACH OF CONTRACT, STRICT LIABILITY, OR ANY OTHER THEORY.

YOUR USE OF THE APP IS AT YOUR OWN RISK. YOU ASSUME FULL RESPONSIBILITY FOR ANY CONSEQUENCES RESULTING FROM YOUR USE OF THE APP, INCLUDING ANY DECISIONS MADE BASED ON APP DATA OR INSIGHTS.

This limitation of liability applies to the fullest extent permitted by applicable law and shall survive any termination of these Terms or your use of the App.

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the developer from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the App

• Your violation of these Terms

• Your violation of any rights of another party

• Your reliance on the App for medical or health decisions

• Any data or content you enter into the App

11. TERMINATION

You may stop using the App at any time by uninstalling it from your device.

The developer reserves the right to suspend or terminate your access to the App at any time, with or without cause or notice, for any reason, including if you violate these Terms.

Upon termination, your right to use the App will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. CHANGES TO TERMS

The developer reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms in the App or on the developer's website.

Your continued use of the App after any changes to these Terms constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the App.

13. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

14. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the developer regarding the use of the App and supersede all prior or contemporaneous communications and proposals.

BY USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF USE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. YOU ALSO ACKNOWLEDGE THAT YOU UNDERSTAND THE APP IS NOT A MEDICAL DEVICE AND IS NOT INTENDED FOR DIAGNOSIS, TREATMENT, OR PREVENTION OF ANY MEDICAL CONDITION.
